Terms of Use

Introduction
These Terms of Use ("Terms") govern your use of the Karigur Inc. ("we," "us," or "our") website, karigur.com (the "Site"), and any purchases made either online or in-person at our two store locations at 49-150 New Delhi Dr, Markham ON L3S 0B6, and 119-5602 Tenth Line W, Mississauga, ON L5M 7L9. By accessing our Site or making a purchase, you agree to abide by these Terms.

1. Intellectual Property and Promotional Use

Karigur retains full intellectual property rights to all designs and garments. By purchasing a garment, you acknowledge that you will not reproduce, replicate, or commercially exploit our designs without our express written consent. The design rights remain with Karigur after purchase.

We reserve the right to use any publicly posted photos or videos of customers wearing our garments for promotional purposes. If such media is posted by you or third parties, you agree to provide high-resolution images or videos upon request and release all model rights for promotional use. Karigur does not need to inform customers or ask for consent when reposting images or videos found online featuring customers wearing our garments. Consent is irrevocably provided to Karigur and its agents when publicly visible images of our products are posted on platforms such as Facebook, Instagram, Snapchat, WhatsApp, TikTok, YouTube, and Pinterest.

2. Purchase Orders, Payments, and Deposits

  • In-Store Orders: A 50% non-refundable deposit is required to begin production. By making this deposit, you acknowledge and accept these Terms.
  • Online Orders: Full payment is required at the time of purchase. No deposits apply to online orders.

3. Return and Refund Policy

We accept returns only in cases of manufacturing defects. All other sales are final once you take possession of the product either via delivery or in-store pickup.

4. Product Warranties and Liability

All warranties expire once you receive the garment. Karigur holds no liability for the garment’s condition or use after it leaves our store.

5. Collection and Storage

Garments not collected within 45 days after completion will be considered abandoned, and ownership will transfer to Karigur. Deposits and payments will be forfeited.

6. Dispute Resolution

Any disputes arising from purchases or business dealings with Karigur must be resolved through arbitration. By conducting business with us, you waive the right to take Karigur to court. Arbitration will be held in Toronto, Canada.

7. Modifications to Terms

Karigur reserves the right to update or change these Terms at any time without notice. It is your responsibility to review these Terms periodically. Continued use of the Site constitutes acceptance of any changes.

Customer Purchase Order Terms

These terms apply to all in-store and online purchases with Karigur. By making a purchase, you agree to the following:

1. Deposit and Payment Terms

  • In-Store Orders: A 50% non-refundable deposit is required to begin production. This deposit confirms your acceptance of these terms.
  • Online Orders: Full payment is required at the time of purchase.

2. Customization and Finality

Once a deposit or full payment is made, no further modifications to the design are allowed. You confirm that you approve all design details before the deposit or payment is made.

3. Artisanal Craftsmanship

Our garments are handcrafted, and as such, variations in fabric, dye, beadwork, and embroidery are natural. These variations are not defects but rather characteristics of artisanal craftsmanship. By purchasing, you agree to accept these variations.

4. Alterations and Fit

  • Custom orders include one complimentary fitting and alteration.
  • Additional alterations, or any alterations for ready-to-wear items, will incur extra fees.
  • Karigur is not responsible for alterations done by third parties.

5. Return and Refund Policy

Returns are accepted only for manufacturing defects. All other sales are final, and deposits are non-refundable.

6. Collection and Storage

Garments not collected within 45 days after notification of completion will be considered abandoned, and ownership will transfer to Karigur. All deposits and payments will be forfeited.

7. Promotional Use

Karigur reserves the right to use any publicly posted photos or videos featuring its garments for promotional purposes. The Purchaser agrees to provide high-resolution photos or videos if requested and releases model rights for such media to Karigur.

8. Intellectual Property Rights

Karigur retains exclusive design rights to all garments. The Purchaser is not permitted to reproduce or exploit the design for commercial purposes.

9. Review and Reputation Protection

You agree not to publish false, defamatory, or malicious content regarding Karigur or its products. We encourage direct communication to resolve any concerns.

10. Liability and Indemnification

Once you receive your garment, Karigur is no longer liable for its condition or subsequent use. You agree to indemnify Karigur against any claims or liabilities arising from the use of the product.

11. Dispute Resolution

Disputes will first undergo mediation in Markham, Ontario, Canada. If mediation fails, arbitration will be the next step. Litigation will only be considered if both methods fail.
