These Terms of Use ("Terms") govern your use of the Karigur Inc. ("we," "us," or "our") website, karigur.com (the "Site"), and any purchases made either online or in-person. By accessing our Site or making a purchase, you agree to these Terms.

1. Intellectual Property and Promotional Use

Karigur retains full intellectual property rights to all designs and garments. You may not reproduce or commercially exploit any designs without our written consent. We reserve the right to use publicly posted photos of customers wearing our garments for promotional purposes without further notice.

2. Purchase Orders, Payments, and Deposits

Custom Orders (In-Store Only): A 50% non-refundable deposit is required to begin production. By making this deposit, you accept these Terms.
Online Orders: Full payment is required at the time of purchase. No deposits apply to online orders.

3. Return and Refund Policy

We accept returns only for manufacturing defects. All other sales are final after delivery or pickup.

4. Product Warranties and Liability

All warranties expire upon receipt of the garment. Karigur is not liable for its condition or use after leaving our store.

5. Collection and Storage

Garments not collected within 45 days after completion will be considered abandoned, and ownership will transfer to Karigur. Deposits and payments will be forfeited.

6. Dispute Resolution

All disputes must be resolved through arbitration in Mississauga, Canada. By conducting business with us, you waive the right to take Karigur to court.

7. Modifications to Terms

We reserve the right to update these Terms at any time. It is your responsibility to review them periodically. Continued use of the Site, in-store visitation, or communication with Karigur constitutes acceptance of any changes.

Purchase Policy

• Payment: Full payment is required at the time of purchase for all online orders.
• Shipping: We ship to the address specified at checkout. Shipping times and costs will be calculated and displayed at checkout.
• Returns and Refunds: Online orders are final unless there is a manufacturing defect. You must report any defects within 24 hours of receiving the item.

Dispute Resolution

All disputes related to online orders must be resolved through arbitration, as described in our general Terms of Use.

1. Definitions

• Custom Garment: Made-to-order garments created per client specifications.
• Ready-Made Garment: Pre-designed, in-stock garments available for immediate purchase.
• Force Majeure: Events beyond Karigur's reasonable control, including but not limited to strikes, political unrest, war, natural disasters, and supply chain or labour disruptions.

2. Prices, Shipping, Duties & Taxes

All prices are quoted in Canadian Dollars (CAD) unless otherwise specified. Purchasers are solely responsible for all shipping costs, duties, customs fees, taxes, and any related charges without exception.

3. Ordering, Deposits & Payments

• Custom Garments: Production requires a 50% deposit at the time of order placement. This deposit covers a portion of the direct design, materials, and labour costs already committed and is non-refundable once these costs are incurred.
• Ready-Made Garments: Full payment is required upon purchase.

Any changes requested by the Purchaser after the initial deposit or payment constitute additional work and will incur extra fees.

4. Production & Delivery Timelines

Custom Garments are handmade and subject to production variations. Quoted delivery timelines are estimates and may extend by 1–3 weeks. Karigur is not responsible for delays caused by Force Majeure events or factors outside our reasonable control.

5. Design Confirmation

Payment of a deposit or full amount confirms final approval of all design details as documented in the purchase invoice. Further modifications after payment require Karigur’s written consent and will incur additional charges.

6. Artisan Craftsmanship

Garments are handmade; minor variations in colour, fabric texture, embroidery, bead placement, and measurements are inherent characteristics and not considered defects. Hand-dyed fabrics cannot be perfectly replicated, and colour hues may vary by up to 15% when dyeing fabric.

7. Alterations & Fittings

Custom Garments include one complimentary fitting and payment up to a $100 value towards an alteration session with a third-party seamstress. Additional alterations or any alterations to Ready-Made Garments are the client's responsibility. Karigur can recommend third-party seamstresses, but all arrangements and payments for alterations beyond the complimentary session are solely between the client and the seamstress. Karigur is not responsible for alterations conducted by third-party seamstresses.

8. Garment Collection & Abandonment

Completed garments must be collected or shipment arranged by the Purchaser within 45 days of notification. Items uncollected beyond this period are deemed abandoned. Karigur will attempt to provide at least three notices via email or phone. After 60 days, Karigur reserves the right to sell, donate, or dispose of abandoned garments in accordance with Ontario’s Repair and Storage Liens Act. Payments made on abandoned items are forfeited.

9. Delivery, Risk & Insurance

Ownership and risk transfer to the Purchaser upon pickup or delivery to the shipping carrier. Insurance coverage is the Purchaser's responsibility.

10. Returns, Exchanges & Warranty

• Ready-Made Garments: Eligible for exchange or repair only in cases of manufacturing defects reported within 24 hours of delivery or pickup.
• Custom Garments: Due to their bespoke nature, returns are not permitted. Karigur will correct material defects—defined as defects significantly deviating from approved design specifications—if reported within 24 hours of delivery or pickup.

Manufacturing defects or significant deviations cannot be confused with inherent qualities and traits of handmade, embellished, or embroidered garments and accessories, such as minor bead loss, colour hue variations up to 15%, or slight measurement variations.

Nothing in this agreement limits your statutory rights under Ontario’s Consumer Protection Act or Sale of Goods Act.

11. Limitation of Liability

Karigur's liability is strictly limited to the total price paid by the Purchaser, except for injury or loss caused by Karigur’s negligence. Karigur is not responsible for indirect or consequential losses.

12. Intellectual Property

All garment designs, sketches, photographs, and promotional materials remain the intellectual property of Karigur. Purchasers must not replicate, reproduce, or commercially exploit these designs without explicit written consent.

13. Promotional Use of Images (Opt-Out)

By completing your purchase, you grant Karigur the right to use your publicly posted photos or videos for promotional purposes, without further notice or consent, unless you opt out in writing. This includes images and videos found on Facebook, Instagram, TikTok, and similar platforms. The Purchaser agrees to provide high-resolution photos and releases all model rights for promotional use to Karigur upon request. Purchasers may opt out by notifying Karigur in writing. Upon written opt-out, Karigur will remove any such media from its channels within 30 business days.

14. Dispute Resolution

Disputes may be resolved through mediation or arbitration in Mississauga, Ontario; participation is voluntary.

15. Governing Law

This agreement is governed by Ontario and Canadian law. All proceedings will be in Ontario unless otherwise agreed in writing.

16. Care Instructions

Professional spot-cleaning only. Machine washing or dry cleaning may damage garments or accessories.

17. Entire Agreement & Acceptance

This agreement is posted on Karigur’s website, linked in receipts, and displayed in-store. Completion of payment constitutes acceptance. These terms supersede all previous versions.

18. Notice

This agreement is readily available on Karigur’s website, linked on purchase receipts, and prominently displayed at Karigur’s store. Acceptance is confirmed by completing payment. This summary is provided for convenience only; the formal terms above govern in all circumstances.
